Terms and Conditions
The terms you agree to when you buy from us. They sit alongside our refunds and returns policy, and they do not affect your statutory rights.
These terms apply to every order placed with Garden Rooms for Sale, whether on this website, by telephone or at our showroom. Please read them before you buy. Nothing here affects your statutory rights as a consumer.
1. About us
Garden Rooms for Sale Ltd are retailers of ready-to-assemble garden rooms, log cabins, sheds and garden buildings. In these terms “we”, “us” and “the Company” mean Garden Rooms for Sale Ltd, and “you” means the person named on the order.
You can reach us at:
- Camelia Botnar Garden Centre, Cowfold, Horsham, West Sussex RH13 8NA
- Telephone 01403 458553
- Email info@gardenroomsforsale.co.uk
Our buildings are supplied as kits for assembly. By buying from us you accept that physical work is needed, either from you or from people you instruct, to prepare the site and put the building up. Installation is available on a case-by-case basis and is covered in section 10.
2. These terms
A contract between us is formed when we confirm your order, which we do by email once your payment or deposit has been taken. At that point these terms, the details on your order confirmation and our refunds and returns policy together make up the agreement between us.
We may update these terms from time to time. The version that applies to your order is the one published on the day you placed it, and we will send you a copy with your order confirmation.
3. Planning permission and building regulations
Meeting building regulations is the joint responsibility of the builder and the landowner, not of the supplier. Our buildings are not intended for use where building regulations approval is required, so please check the following before you order. By placing an order you confirm that:
- The building will contain no sleeping accommodation.
- If the building is over 15 square metres of internal floor space, it will be positioned at least 1 metre from any boundary. If it cannot be, speak to your Local Authority Building Control before purchase about appropriate fireproofing.
- If the building is over 30 square metres of internal floor space, you understand that it does not meet the building regulations exemptions, unless you intend to use it for an exempted purpose such as a building people do not normally enter, or for agricultural use, or you intend to modify it after installation so that it complies. Modifications of that kind may invalidate the guarantees on the product.
You are also responsible for confirming whether planning permission applies to your site. Permitted development rules change, and we strongly advise checking with your local planning authority or the Planning Portal. If you are unsure about building regulations, speak to your local Building Control office.
4. Prices and payment
All prices include VAT and free delivery to UK mainland addresses. Delivery outside UK mainland is quoted separately. Prices on this website are the most up to date; where a printed price differs, the website price applies.
At checkout you can either:
- Pay in full. Nothing further is due before delivery.
- Pay a 25% deposit. The balance is due at the latest one week before your delivery date. We email you a secure payment link for it.
We cannot deliver until the balance has been paid and cleared. If the balance is not paid by the due date we may postpone your delivery, and section 14 explains when we may cancel an order for non-payment.
Card payments are taken on the secure page of our payment provider. We never see or store your card details.
Installation, where you have asked for it, is quoted and invoiced separately and paid on completion. It is never charged through this website and does not form part of the price of the building. See section 10.
5. Delivery
Lead times are typically 2 to 4 weeks, or 4 to 6 weeks for the Paradise range. These are estimates and not guarantees: time is not of the essence in this contract. We always use our best endeavours to deliver within the quoted window, and we will contact you to agree a date before we deliver. If something delays your delivery we will contact you to rearrange within a reasonable period. We are not responsible for costs you or a third party incur because of a delay, which is why you should never book an installer before your goods have physically arrived and been checked.
Where we deliver to. Delivery is kerbside or to your driveway: the first safe and accessible point at the front of your property, up to a maximum of 20 metres from the delivery vehicle, provided the vehicle can be legally and safely parked. If there is no suitable space at the front, for example a terraced property with no front garden, the goods will be unloaded at the nearest safe and legal point on the public highway. From that point onwards, moving the goods is your responsibility, and responsibility for the goods passes to you once delivery has taken place.
We do not deliver through side passages, alleyways, gates or garages, into rear gardens, inside any building, or across neighbouring land.
Vehicle access. Deliveries are typically made on a 7.5 tonne flatbed HGV, approximately 8 metres long and 2.6 metres wide, and many of our buildings weigh between 1 and over 4 tonnes. You must make sure the access road can legally and physically take a vehicle of that size and is free from weight, width, height or turning restrictions. You must tell us in writing before delivery about anything that restricts access, including narrow lanes, parking restrictions, permit zones or the absence of space at the front of the property. Damage to lawns, planting, driveways or other surfaces caused by moving goods over them, or by navigating a difficult access route, is not our responsibility.
The route to the drop point. There must be a clear, safe route from the vehicle to the drop point: firm ground, free of trip and slip hazards, no steep or unstable surfaces, at least 750mm wide and clear of obstructions such as bins, parked cars, walls, hedges and low branches. There must also be enough space for the goods to be set down. If no suitable route or space is available, the goods will be left at the nearest safe point within 20 metres of the vehicle, or returned with the driver, and an attempted delivery charge may apply under section 6.
On the day. Our delivery team will telephone up to an hour before arrival, though it may be shorter notice if traffic or earlier drops affect the run. An adult with authority to accept the goods, either you or someone you nominate, must be present to take delivery and to move the goods onwards where that is needed. Our drivers cannot leave goods that have not been signed for. If nobody is there to accept the delivery, the driver will leave and an attempted delivery charge will apply.
What our drivers cannot do. Enter any building or private residence, move goods beyond the safe drop point, take packaging away, give technical or installation advice, or alter delivery notes or these terms.
Packaging. Our buildings are wrapped for transport. Because we deliver on flatbed vehicles, drivers cannot safely take packaging away, so disposing of it is your responsibility. It is worth keeping it until assembly is finished, as it helps protect stored and part-built components from the weather. Most of it, including plastic wrap, strapping and timber packaging, is recyclable.
There is more practical detail on our delivery and installation page.
6. Additional costs
If we attempt a delivery and cannot complete it because the delivery terms in section 5 have not been met, we will charge for that attempt, and the charge is payable before we redeliver. The charge reflects no more than our direct costs in attempting the delivery, and we will tell you the amount before any redelivery is arranged.
If a redelivery needs a different method or vehicle from our standard one, any additional cost of that is also payable before the redelivery takes place. If you decide to cancel after a failed delivery attempt that was not our fault, the cost of that attempt may be deducted from your refund.
7. Your right to cancel
Because you are buying at a distance, you have the right to cancel. The cancellation period ends 14 days after the day on which you, or someone you nominate, takes physical possession of the goods. You may also cancel at any time between placing your order and delivery.
To cancel, tell us in a clear written statement by email to info@gardenroomsforsale.co.uk or by post to the address in section 1. Please include your order reference. We will acknowledge your cancellation in writing, and in the event of a dispute it is for you to show when the contract was cancelled.
The sooner you tell us, the less it costs. If you cancel before we have despatched your building there is nothing to deduct and we refund you in full. If you cancel close to or after delivery, we may make a reasonable deduction from your refund for costs we have already incurred, such as a failed delivery attempt under section 6 or the cost of collecting the goods.
Made-to-order and bespoke buildings. The right to cancel does not apply to goods made to your specification or clearly personalised, once production has begun. Where your order includes anything of that kind we will tell you before you buy.
Refunds are made within 14 days of the goods being returned to us, or of our receiving evidence that you have sent them back.
8. Returns and refunds
Our returns policy, the collection charges that apply, the timber guarantee and our complaints procedure are set out in full on the refunds and returns page, which forms part of these terms. In summary: you may return a building within 14 days of delivery provided it is unused, in its original packaging and in resaleable condition, and collection charges apply.
If any of the goods form a commercial unit, you cannot return part of that unit without returning the rest. A unit is a commercial unit if splitting it would materially reduce the value of the goods or change the character of the unit.
9. Damaged or missing items
Check the goods against the components list when they arrive. Anything damaged, broken or missing should be recorded on the delivery note at the time and, where possible, returned with the driver.
If you find damage or a shortage after the driver has gone, tell us within 2 calendar days of delivery. This 2-day notification period helps us resolve things quickly and does not affect your statutory rights, including your right to reject goods within 30 days under the Consumer Rights Act 2015. Missing items will be supplied within a reasonable timeframe.
If glass in a window or door is broken on delivery, you may prefer to have a replacement pane cut locally, as that is usually quicker. We will reimburse up to £25 for a single pane or £50 for a double-glazed unit. Alternatively the damaged window or door can go back with the driver at the time of delivery.
10. Installation
Installation is carried out by our recommended team and is quoted per job. It is invoiced separately from the building and paid on completion, directly on sign-off. The price appears on your order confirmation or invoice but is not included in the price of the building, and it is never taken through this website.
Your base must be ready before we arrive. For log cabins and garden rooms we recommend a concrete base wherever possible, and we can suggest approved contractors if that would help. A level, firm and square base is your responsibility, and a building put up on an unsuitable base is not covered by our guarantees.
- Payment for the assembly service confirms completion and your acceptance that it has been delivered as agreed.
- Assembly services are non-refundable once completed.
- Assembly does not form part of the product guarantee, and we hold no responsibility for the condition of the building after assembly unless a specific fault is reported within 48 hours.
- Where you engage your own installer, we are not party to that agreement. Allow them time to read and understand the instructions, and make sure all parts are present and correct before you book them.
11. Putting defects right
We will supply goods that match the terms of your order. If you believe a product is faulty within a reasonable period after delivery, the person named on the invoice must contact us in writing at info@gardenroomsforsale.co.uk, quoting the order reference.
Characteristics that arise from the natural properties of timber are not defects. Section 12 explains what that covers.
To investigate, we may ask for the component or part numbers from the installation manual along with clear photographs showing the problem and its likely cause. We may also ask for photographs of parts that seem unrelated but could point to the source. We cannot issue replacement parts without the correct part number, because of the number of components across our range.
Where a fault is our responsibility we will offer an appropriate remedy, which may be repair, replacement parts or a partial refund. Where the problem has arisen from something within your control, such as an unsuitable base or location, poor maintenance, materials you supplied or misuse, any work or parts needed will be chargeable.
You must give us a reasonable opportunity to inspect and put right any reported defect. If you arrange repairs yourself or through someone else without giving us that opportunity, we will not reimburse those costs.
12. Timber is a natural material
Timber is a natural material. Variations in colour and grain, minor splits, knots, swelling, shrinkage and movement all occur naturally as temperature and humidity change, and they continue after the building is up. These characteristics are expected, do not affect structural integrity, and are not grounds for return, replacement or refund. We are happy to advise on managing timber movement, but it is a maintenance matter rather than a defect.
Where holes have been pre-drilled they may need slight adjustment on site if the timber has taken up moisture. Minor surface marks can usually be resolved by sanding, and small gaps with wood filler, and we would expect that rather than treat them as faults.
You are responsible for:
- Providing a level, firm base.
- Following the assembly instructions carefully.
- Treating all timber with a suitable preservative within 4 weeks of delivery, and annually thereafter.
- Retreating any cut, drilled or modified sections with a cut-end preservative.
- Providing the tools needed if you are assembling the building yourself.
All dimensions given on this website and in our literature are approximate. Products may vary slightly from photographs, showroom models or descriptions because designs change and timber is sourced in batches, and these variations are not grounds for return.
13. Guarantees
Our timber guarantees run up to 10 years on tongue and groove buildings and log cabins, and up to 15 years on pressure treated buildings, when the building is correctly assembled and maintained. They cover rot, decay and insect infestation. They do not cover natural splits, warping or movement, incorrect or poor installation, timber not treated within the required timeframe, custom modifications, or an incorrect base or unsuitable location. The full detail is on the refunds and returns page.
Guarantees are not transferable and apply to the person named on the original order.
14. Cancellation by us
We may cancel your order if:
- The goods were listed at an incorrect price because of a typographical error or an error in pricing information from our supplier.
- We have offered delivery dates that have been refused, or we have repeatedly tried to reach you by phone, text and email and had no contact for two weeks from our first attempt.
- The balance is not paid as set out in section 4.
- No safe and legal drop point can be agreed for delivery.
If we cancel, we will tell you and refund you within 14 days. We are not obliged to offer compensation beyond that refund. If you expect to be away between placing your order and the end of the lead time, please tell us when you order.
15. Force majeure
We are not liable for any delay or failure to perform caused by something beyond our reasonable control, including acts of God such as storms, floods and fire, natural catastrophes, war, acts of terrorism, civil or military disturbance, industrial action, theft or severe weather.
16. General
- These terms are governed by English law.
- Any dispute is subject to the exclusive jurisdiction of the English courts.
- These terms do not affect your statutory rights.
- If any provision of these terms is found to be invalid or unenforceable, it is severed and the rest remains in full force.
- No change to these terms applies unless it is made in writing by a company director.
- Our drivers and delivery teams have no authority to vary these terms.
How we handle your personal information is set out in our privacy policy. If you have a question about anything on this page, call 01403 458553 or email info@gardenroomsforsale.co.uk. Please contact us if you need these terms in large print.
